𝗔𝗺 𝗜 𝗶𝗻𝘀𝘂𝗿𝗲𝗱 ?In the last four years I have seen an increase in the tendency to seek compensation in the courts from practice owners rather than the dentists who performed the treatment.This is no doubt in part due to the well known corporatisation of practices.Parties in personal injury claims have started to include practice owners and directors in their claims.Also because of the relative complexity of seeking personal injury claims in dental matters, individuals are increasingly going to Tribunals seeking consumer law and contract claims instead of negligence and personal liability.This is important so that practice owners know they should seek indemnity cover for the practice as well as their normal personal cover as practitioners.Some indemnifiers will cover this as a matter of course, but some do not. Some will cover the corporate only if the owner(s) of the corporate treated the complainant patient.In any event, it is worth talking to your indemnifier if you have a practice that engages other dentists about cover because if you as a practice owner are a party to civil litigation arising from dental treatment performed by others in the practice - your insurance may not cover the risk.However this does in no way relieve practitioners from their need to comply with the AHPRA registration standards required for appropriate indemnity insurance to cover their scope of practice. ... 𝗜𝘁'𝘀 𝗝𝘂𝘀𝘁 𝗮 𝗖𝗮𝘀𝗲 𝗖𝗼𝗻𝗳𝗲𝗿𝗲𝗻𝗰𝗲Since AHPRA and the boards commenced these case conferences in the last couple of years, some of those who assist dental practitioners have tended to form the view that these are peer related processes and therefore less formal. There may be dental practitioners talking with the subject practitioners at these conferences with the AHPRA officers, but informal or some “roll the arm over” meeting they are most definitely not.It maybe that these case conferences were intended to resolve some issues of regulatory action in a different setting, but time and time again I am aware of:1. Practitioners attending alone because their indemnifier appointed support person is not available or considered it was not necessary.2. Case conferences with serious ramifications because practitioners were ill prepared or poorly advised.If you are asked to participate in a case conference, it could be a ‘good thing’ but don’t attend alone, and don’t think it is a friendly chat.
